Ann Rout's Will

This the last will and testament of Ann Rout of the township of Walnut in the County of Pickaway Ohio. I Ann Rout considering the uncertainty of this mortal life and being of sound mind and memory, blessed be Almighty God for the same, do make and publish this last will and testament in manner and from following viz. first, I give and bequeath unto my beloved son Jefferson Rout all my personal estate horses, cattle, hogs and sheep likewise poultry of every kind also all my interest in my deceased Husband's estate both real and personal, all my beds and bedding Household and kitchen furniture of every kind and nature thereunto appertaining. Further I will and bequeath to my grand daughter Ann Ward twenty five pounds of feathers also one sheet and one bed quilt, also my secashen [section?] flock also my sister Elizabeth Green my plad flannel flock also to my sister Lucinda Sage one black bombazine dress and further the rest of my wearing apparel to be equally divided between my two daughters Matilda Ward and Fanny Anderson.
This my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto put my hand and seal this fourth day of June in the year of our Lord Eighteen Hundred and thirty two.

Signed sealed published and delivered by the above named Ann Rout to be her last will and testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the testator.

Personally appeared in Open Court Nathaniel W. Harper and Ezekiel Skinner the two subscribing witnesses to a paper dated 4th day of June 1832 purported to be the last will and testament of Ann Rout deceased and made oath that the same is the true last will and testament of the said Ann Rout deceased, that the said Ann Rout signed the said will in the presence of the deponents, and that these deponents attested and subscribed the same as witnesses in the presence and at the request of the said Ann Rout, that the said will was written by Ezekiel Skinner at the request of said Ann Rout. And further these deponents say that the testatrix at the time of executing said will was of full age, of sound mind and memory, and not under any restraint.

DESCENDANTS OF #3 THOMAS ATHY (2)
As the oldest son of #3 Thomas Athy (2), #8 Thomas Athy, Jr. (3)
seems to have acquired the Athy family property in Maryland except for the home place, "Stony Hill", where his father probably lived. In 1741 he bought "Chance Situate", a 100 acre tract, located between Piscataway Creek and Mattawoman Creek near "Hopewell"; however, he sold this tract in 1745. Even though his father outlived him, he had acquired the 80 acre family tract "Hopewell" prior to 1748 at which time he requested that its boundries by established by a commission appointed by the
County. Futhermore, he also acquired the 200 acre tract, "Athey's
Choice", from his father at some time prior to his father's death in 1761.
In his will, he left 80 acres ("Hopewell") to his daughter #20
Mary Athy (4) and 200 acres ("Athey's Choice") to be divided equally between his daughters #21 Lucy Athy Feagins (4) and #22 Sarah Athy Staige (4). In the will both properties are referred to as "Athey's Choice", certainly in error, although it is possible that the two properties are adjacent and had been combined.
Mary sold her 80 acres in 1774. Thomas' wife Sarah demanded and
received her widow's third of the 200 acre tract and sold it in 1779. Daughters Lucy and Sarah also sold their thirds of the 200 acres in 1779. Lucy and Sarah lived in Fauquier County in Virginia at that time; and Mary also lived in Virginia, possibly in Fauquier County.
