A false imprisonment case in which John Banks was plaintiff and Charlotte Biche was defendant was placed on trial at the opening of court this morning, but after the first witness had been sworn the court granted a nonsuit. F. N. Fitch appeared for the plaintiff and Thomas F. Kearns for the defendant.
John Banks, the plaintiff, is a well known character of this city. Charlotte Biche, the defendant, is the wife of John Biche, and her maiden name was Charlotte Banister, being a daughter of the late Governuer Banister. She has frequently appeared in the courts, either as plaintiff or defendant. She owns a farm in the town of Pamelia and on it is a stone quarry. This quarry was in the posession of John Banks for about a year and six months, under an agreement whereby he was to pay Mrs. Biche 10 cents for every doubly load of stone quarried. of the premises. She ??? a warrant for the arrest of Banks on the charge of trespass for quarying stone on her premises and carrying them away without her permission. Banks was tried before Justice John ? Parish at Pamelia, convicted and sentenced to pay a fine of ?? or serve 10 days in jail. He was committed. After being in jail a few days he was released on a writ of habeus corpus by Judge Emmerson. It appeared that the judgement was void. Banks then commenced this action to recover $2,000 damages for false imprisonment.
The law provides that a person cannot recover damages for false imprisonment unless the judgement is reversed or void. The judgement of the justice's court was not reversed in this case. In the opening address Mr. Fitch stated that Banks had been convicted. When he concluded Mr. Kearns moved for a nonsuit on the grounds that the judgement of the justice's court had not been reversed. The court allowed Mr. Fitch to call Constable N. H. Merrills, who made the arrest, but after his testimony was taken, Justice Williams granted the motion for a nonsuit, holding that the complaint made by Mrs. Biche charged a crime.
