John M. Sixbury Developed Blood Poisoning
Husband's Death Resulted
Contention Made That Meat Which Sixbury Handled While At Work Was Coated With a Poison Which Preserved It.
Charging that her husband, John Sixbury, late of this city, died as a result of poisoning contracted in handling meat, Mrs. Minnie L. Sixbury of 414 Lansing Street, has brought suit in supreme court against John Sulserberger & Son Co. of Chicago, and Horace E. Tyler, of this city, to recover $25,000 for his death.
Mr. Sixbury died Feb. 9, 1914, from blood poisoning, which it is charged was contracted in handling meat shipment in this city Jan. 13. While Mr. Tyler, by whom Sixbury was employed, is made a defendant, the principal claim of negligence is understood to be against the Chicago packers.
The meat shipment was from Minneapolis to G.B. Harris cold storage in this city and Mr. Tyler was employed in handling the shipment. It is understood that the plaintiff will contend that Mr. Sixbury had sustained a scratch on the first finger of his left hand the day before he was engaged in handling the meat, and it is alleged that he became infected by poison on the outside of the meat to preserve it, resulting in his illness and ending in his death.
The administratrix will charge that the shippers were negligent in failing to provide the meat with a suitable covering, and that a poisonous ingredient, including formaldehyde had been added to the meat, without label as covering, injurious to health and rendering the meat dangersous and unsafe to handle or touch. Sixbury had no knowledge of the nature of the preservative, it will be argued.
Carlisle and Brown will defend the suit for Mr. Tyler. Joseph T. McCafrey, of Oswego, is the local counsel for the Chicago firm. Thomas Burns, who represented Mrs. Sixbury in the proceedings in surrogate's court, will be her attorney in the negligence actions.
