The Last Will and Testament of Peter Hoover, Deceased
Be it remembered, That heretofore, to wit: on the 22nd day of March in the year of our Lord, one thousand eight hundred and seventy nine - Philip Helmer of Le Ray, Jeffersopn County New York, one of the Executors named in the last Will and Testament & Codicil thereto annexed of Peter Hoover late of the Town of Le Ray in the County of Jefferson deceased, appeared in open Court, before the Surrogate of the County of Jefferson and made application to have the said last Will and Testament and the said Codicil which relates to both Real and Personal Estate, proved : and on such application the said Surrogate did ascertain by satisfactory evidence who were the ___ heirs at law and next of kin of the said testator, and their respective residences, and they are as follows, Vis. Catharine Walradt of Le Ray and Sarah Bacon, Betsey C. Helmer, Mary A. Petrie and Almeda E. Hoover all of Le Ray aforesaid and Clarinda Walradt of Theresa and all of Jefferson County aforesaid, Isaac Hoover of Defiance, Ohio, and Jacob A. Hoover of Empire City, Ormsby County, Nevada, children of said deceased, all of said persons are of full age
and said Surrogate did thereupon issue a citation in due form of law, directed to the said heirs at law and next of kin of aforesaid testator by their respective names, stating their respective places of residence and requiring them to appear before said Surrogate at this office in the City of Watertown in said County on the 2nd day of May A. D. 1879 to attend the Probate of said Will and said Codicil.
And afterwards, to wit : on the 2nd day of May A. D., 1879 satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of said citation in the mode prescribed by law, and on that day, no one appearing to oppose the Probate of such Will & Codicil such proceedings were thereupon had in said Court afterwards, that the said Surrogate took the proofs of said Will and of said Codicil hereinafter set forth, upon this 2nd day of May A. D. 1879, and he thereupon adjudged the said will and the said Codicil to be a valid Will and Codicil of Real and Personal Estate, and the proofs thereof to be sufficient, which said last Will and Testament and said Codicil and proofs, are hereinafter recorded in this book.

In the presence of God, Amen
I, Peter Hoover of Le Ray, Jefferson County, New York of the age of Eighty Eight years being of sound mind and memory and considering the uncertainty of of this frail and transitory life do therefore make, ordain, publish, and decalre this to be my last will and testament, that is to say:
First.
After all my lawful debts are paid and discharged I give and bequeath to my daughter Almeda E. Hoover the sum of five hundred dollars, this being in full payment and discharge of any and all claims that she has or may have for taking care of me during my life.
Second.
All the residue and remainder of my estate both real and personal of every kind and description I give and bequeath to my eight children viz: Isaac Hoover, Jacob Hoover, Catharine Walradt, Sarah Bacon, Betsey C. Helmer, Clarinda Walradt, Mary A. Petrie and Almeda E. Hoover to be equally divided between them share and share alike.
Third
For the purpose of making such division of my property amoung my said children I hereby authorize and empower my Executors hereinafter named to sell and convey all my Real Estate and grant letters thereto - and that my said Executors shall have two years after my decease in which to sell my real Estate & that the leagcies above named shall not be due and payable until after the said two years.
Likewise, I make, constitute and appoint my two sons-in-law, Philip Helmer and George Petrie to be executors of this my last will and Testament hereby revoking all former wills by me made.

In the matter of the application of Elizabeth Huber for a pension as the widow of Henry Huber late of the Town of Little Falls deceased
Herkimer County Ls George Rosencrantz of the town of Little Falls, County of Herkimer and State of New York being duly sworn saith that he is seventy years of age and upwards, and that his father was the Rev. Abraham Rosencrantz the minister of the Reformed protestant Dutch Church in the German Flats in the now county of Herkimer from the anchist revolution of deponent previous to the Revolutionary War & during that war & long afterwards until his death - that a short time since Peter Huber of the county of Jefferson a son of old Captain Henry Huber called upon this deponent to search the records kept by this deponents father of marriages where the ceremony was perfomed by him & alledged that his mother stated that she was married to said Henry Huber by deponents father. This deponent saith he searched the only book of records in deponents posesion of his fathers record of marriages & could not find the marriage of said Henry Huber and in fact no record of marriages going so far back in date as the widow of said Henry Huber alledges they were married, and deponent saith that said Peter also searched said book of records & which book deponent states is the only book of records of baptisms and marriages or letters extant and that when his father died about the year 1796 all his books & papers extant were left in the care and posesion of this deponent. This deponent saith that on Saturday the second of December instant he was looking over some papers which he supposed useless in an old chest of drawers and that

in looking them over he came across a half sheet, or leaf, of paper in his said fathers hand writing and on which he found the record of marriages commencing with the 15th day of February 1774 and ending the first day of November of the same year, on which half sheet or leaf of a book is the record of the marriage of said Henry Huber in the record spelled in the German Henrich Huber to Elizabeth Frank on the 27th M

Side note:
Adam Loux (now Loucks), whose house, about three-fourths of a mile north of Stone Arabia, on the farm now occupied by J. Ervin Graff, was a meeting place of the Tryon county Committee of Safety, was born in Schoharie, N. Y., Dec. 15th, 1715; was married Oct. 16th, 1739, and died Feb. 14th, 1789. His son, Peter Loucks, was first lieutenant of the 3d company of the Palatine battalion, under Capt. Christopher W. Fox, at the battle of Oriskany.
