Last Will and Testament

John Biggars
Deceased [pg.] 612
Be it Remebered, That heretofore, to wit: on the 7th day of October in the year of our Lord one thousand eight hundred and seventy six William Tamblin of Macomb St. Lawrence County, New York, Executor named in the Last Will and Testament of John Biggars late of the Town of Theresa in the County of Jefferson deceased, appeared in open Court before Ross C. Scott, special Surrogate of the County of Jefferson and made application to have the said last Will and Testament which relates to both Real and Personal Estate, proved: and on such application the said special Surrogate did ascertain by satisfactory evidence who were the widow heirs at law and next of kin to the said testator, and their respective residences,
and they are as follows: John Biggars Jr. and James Biggars of Theresa, and Rachel Bowker of Brownville & Selena Youl of Adams, all of Jefferson County, N.Y., and Maria Tamblin of Macomb St. Lawrence County, N.Y., children of said deceased all of full age, said James being of unsound mind and Jane Biggars of Theresa aforesaid, widow of said deceased of full age.
And said Special Surrogate did thereuppon issue a citation in due form of law, directed to the widow, heirs at law and next of kin of said testator by thier respective names stating their respective places of resididence and requiring them to appear before the Surrogate of said County at his office in the City of Watertown in said County, on the 18th day of October A.D. 1876, to attend the Probate of said Will and afterwards to wit on the 18th day of October A.D. 1876. Satisfactory evidence by affidavit was produced & presented to said surrogate of the due service of said citation in the mode prescribed by law & thereupon said Surrogate duly appointed Ross C. Scott of said City of Watertown Special Guardian of the said James Biggars for the sole purpose of appearing for him & taking care of his interests in this matter, said Special Guardian immediately appeared in person before said Surrogate.
And on that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards, upon this 18th day of October A.D. 1876, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said last Will and Testament and proofs, are hereinafter recorded in this book.

In the name of God, Amen. I John Biggars of the Town of Theresa in the County of Jefferson, State of New York of the age of seventy three years and being of sound mind and memory do make, publish and declare this my last will and testament in manner following:
First
I give and bequeath unto my beloved wife Jane all my household furniture of every name and nature and one cow - also the use of my farm on which I now reside for her use so long as she remains my widow, and is not to cut any standing timber unless for necessary buildings on said farm. Cut dead and down timber for fuel for her use and after her decease to go to my heirs.

I give and bequeath unto my son John the farm I now reside being and lying in the Town of Theresa.
I give and bequeath unto my daughter Rachel Belker four hundred dollars. I give and bequeath unto my daughter Maria Tamlin four hundred dollars. I give and bequeath unto my daughter Selena Yoe one hundred dollars. The above legaces are to be paid by my son John in one year after the decease of the said Jane. And lastly it is my wish and desire to have my son take care of my son James if he should come around once and a while as he formally used to do.
And lastly I direct after my decease to have my funeral expenses, tombstones, doctors bills paid out of my estate.
I do hereby nominate and appoint William Tamlin to be the Executor of this my last will and testament hereby revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal this 3 day of Aug 1876.

Paul,
Got your message about photocopies and I just wanted to inform you that the powers that
be are already in motion. My mother never has really expressed an interest in the
search of heritage and history, yet once I informed her of someone related to her
Grandfather Arthur Biggers, well... She has called me to tell me she got all her
records and documents out. We are both in the process of getting all these lines and
supporting documents into a format her Grandchildren & Great-Grandchildren can have.
You though won't have to wait that long as soon as I'm sure we've got all are notes
properly copied they along will copies of all other documents will be on the way to you
& your family. These papers will include the family line written by Arthur's own hand.
I have been reviewing the Biggers line more this week and I can now tell you that John I
came to America at the age of 38 somewhere in the range of 1842-43. He started a Carding
Mill in Dexter N.Y. His farm was 2 miles north of Brownsville N.Y. Wife Fannie Harris
died at age 56. Their children were: John II b. 1839 England // George b. abt. 1842
England // Maria b.1844 New York //James (Jim) b. 1846 (listed as a Robert 1860 census
???) The brothers John and George were available for duty at the beginning of the Civil
War. John did not join but fled to Maryland where he spent time aboard a whaling ship
and was also taken prisoner at some point and sometime later is said to have escaped.
Maybe the tales of his adventures were in his head as told to kin when he returned or
fact, maybe a little of both. George was not so lucky, Hit by a cannon ball and killed
Battle of Bull Run, Manassas, Va. after 1862, so that would make it the second battle.
Youngest son James was said to have been a math genius, "Hit in the head by his
stepmother for eating one of her pies and was never the same." I hope the pie was good.
The Stepmother John I's 2nd wife was Jane Graves b. Ireland 1819 d. 1908 / 89 years.
Graves was her 1st husband's name. Her children by Graves:
John Graves 1844 // Wm. Graves 1846 // Joseph Graves 1849 // Barnett Graves 1851 //
Approx date by census ages.
John II / oldest daughter Stella never married and is buried next to her Grandfather

June 18,1910. Strange your name is Paul. Is your line Eva's Paul Webert. We want to
know more about Eva's sons and where they went and the lives they lead. Arthur's
children where artists / landscape architect / naturalist / seems thay had a deep
appreciation for nature's beauty.

I popped into the local library and discovered they had a printed paper version of the tithe map so photocopied the relevant bit. Enlarge it to 50% and it's really clear. Our house is plot no. 687 (towards left hand side of West End).
The key for the plot said: Mr John Biggers, in hand, house, outbuilding, garden and yard.
'in hand' means he lived there too. Obviously in those days lots of people owned property that they rented out.
I'm sure you know the website www.genesreunited.co.uk ? It's very good for British family tree research. I've made lots of contacts through it - even got to meet (in the flesh) a second cousin we never knew existed.

Just found your family history website on Google. We live on West End, Witney and have been researching the history of the street. We have a website www.witneywestend.com The street is probably the oldest in Witney, many of the houses date back to 1600s.Today we looked at the 1839 Tithe map in the local museum and worked out that our house 45 West End is where John Biggers lived. This huge map has a key to all the house/land owners at that time and although there are no house numbers until late 1800s, the shape of the houses hasn't changed much in several hundred years so we can be quite confident we have the right plot. Thought you might be interested and certainly it's fascinating to see your information about people who lived in our house all those years ago...

We're fairly confident it's the John Biggers born 1804 or his father - depends which of them actually owned the property. As it was the 1839 tithe map and then in 1841 census, no other John Biggers living in West End, I assume it's yours?
The tithe map is very big and behind glass - we can see if we'd be allowed to take a photo and whether it would come out ok. We'll be doing a lot more research on West End over the coming months for our website so if we come across anything relating to Biggers families, we'll pass it on. Is Jeremiah Biggers one of yours - his name comes up a bit in records - I think he was a blanket weaver and fairly affluent.
It was your old website we saw. I'll have a look at your new one today.
Here are some photos of the front of the house. It was built late 1600s and is fairly unchanged (apart from modern comforts like central heating, bathrooms etc!) The outbuilding was knocked down by a previous owner but otherwise the shape and size has been the same for nearly 300 years. It's built of stone, full of old beams, flagstone floors, winding staircases, etc. It as probably associated with blanket weaving for many years as we're a few houses down from one very old blanket mill. Although we know in the 1920s it was a sweet shop! Am happy to send interior photos if that would be of interest.

Be it Remebered, That heretofore, to wit: on the 7th day of October in the year of our Lord one thousand eight hundred and seventy six William Tamblin of Macomb St. Lawrence County, New York, Executor named in the Last Will and Testament of John Biggars late of the Town of Theresa in the County of Jefferson deceased, appeared in open Court before Ross C. Scott, special Surrogate of the County of Jefferson and made application to have the said last Will and Testament which relates to both Real and Personal Estate, proved: and on such application the said special Surrogate did ascertain by satisfactory evidence who were the widow heirs at law and next of kin to the said testator, and their respective residences,
and they are as follows: John Biggars Jr. and James Biggars of Theresa, and Rachel Bowker of Brownville & Selena Youl of Adams, all of Jefferson County, N.Y., and Maria Tamblin of Macomb St. Lawrence County, N.Y., children of said deceased all of full age, said James being of unsound mind and Jane Biggars of Theresa aforesaid, widow of said deceased of full age.
And said Special Surrogate did thereuppon issue a citation in due form of law, directed to the widow, heirs at law and next of kin of said testator by thier respective names stating their respective places of resididence and requiring them to appear before the Surrogate of said County at his office in the City of Watertown in said County, on the 18th day of October A.D. 1876, to attend the Probate of said Will and afterwards to wit on the 18th day of October A.D. 1876. Satisfactory evidence by affidavit was produced & presented to said surrogate of the due service of said citation in the mode prescribed by law & thereupon said Surrogate duly appointed Ross C. Scott of said City of Watertown Special Guardian of the said James Biggars for the sole purpose of appearing for him & taking care of his interests in this matter, said Special Guardian immediately appeared in person before said Surrogate.
And on that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards, upon this 18th day of October A.D. 1876, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said last Will and Testament and proofs, are hereinafter recorded in this book.

In the name of God, Amen. I John Biggars of the Town of Theresa in the County of Jefferson, State of New York of the age of seventy three years and being of sound mind and memory do make, publish and declare this my last will and testament in manner following:
First
I give and bequeath unto my beloved wife Jane all my household furniture of every name and nature and one cow - also the use of my farm on which I now reside for her use so long as she remains my widow, and is not to cut any standing timber unless for necessary buildings on said farm. Cut dead and down timber for fuel for her use and after her decease to go to my heirs.

I give and bequeath unto my son John the farm I now reside being and lying in the Town of Theresa.
I give and bequeath unto my daughter Rachel Belker four hundred dollars. I give and bequeath unto my daughter Maria Tamlin four hundred dollars. I give and bequeath unto my daughter Selena Yoe one hundred dollars. The above legaces are to be paid by my son John in one year after the decease of the said Jane. And lastly it is my wish and desire to have my son take care of my son James if he should come around once and a while as he formally used to do.
And lastly I direct after my decease to have my funeral expenses, tombstones, doctors bills paid out of my estate.
I do hereby nominate and appoint William Tamlin to be the Executor of this my last will and testament hereby revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal this 3 day of Aug 1876.

Last Will and Testament

John Biggars

Be it Remebered, That heretofore, to wit: on the 7th day of October in the year of our Lord one thousand eight hundred and seventy six William Tamblin of Macomb St. Lawrence County, New York, Executor named in the Last Will and Testament of John Biggars late of the Town of Theresa in the County of Jefferson deceased, appeared in open Court before Ross C. Scott, special Surrogate of the County of Jefferson and made application to have the said last Will and Testament which relates to both Real and Personal Estate, proved: and on such application the said special Surrogate did ascertain by satisfactory evidence who were the widow heirs at law and next of kin to the said testator, and their respective residences,
and they are as follows: John Biggars Jr. and James Biggars of Theresa, and Rachel Bowker of Brownville & Selena Youl of Adams, all of Jefferson County, N.Y., and Maria Tamblin of Macomb St. Lawrence County, N.Y., children of said deceased all of full age, said James being of unsound mind and Jane Biggars of Theresa aforesaid, widow of said deceased of full age.
And said Special Surrogate did thereuppon issue a citation in due form of law, directed to the widow, heirs at law and next of kin of said testator by thier respective names stating their respective places of resididence and requiring them to appear before the Surrogate of said County at his office in the City of Watertown in said County, on the 18th day of October A.D. 1876, to attend the Probate of said Will and afterwards to wit on the 18th day of October A.D. 1876. Satisfactory evidence by affidavit was produced & presented to said surrogate of the due service of said citation in the mode prescribed by law & thereupon said Surrogate duly appointed Ross C. Scott of said City of Watertown Special Guardian of the said James Biggars for the sole purpose of appearing for him & taking care of his interests in this matter, said Special Guardian immediately appeared in person before said Surrogate.
And on that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards, upon this 18th day of October A.D. 1876, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs thereof to be sufficient, which said last Will and Testament and proofs, are hereinafter recorded in this book.

In the name of God, Amen. I John Biggars of the Town of Theresa in the County of Jefferson, State of New York of the age of seventy three years and being of sound mind and memory do make, publish and declare this my last will and testament in manner following:
First
I give and bequeath unto my beloved wife Jane all my household furniture of every name and nature and one cow - also the use of my farm on which I now reside for her use so long as she remains my widow, and is not to cut any standing timber unless for necessary buildings on said farm. Cut dead and down timber for fuel for her use and after her decease to go to my heirs.

I give and bequeath unto my son John the farm I now reside being and lying in the Town of Theresa.
I give and bequeath unto my daughter Rachel Belker four hundred dollars. I give and bequeath unto my daughter Maria Tamlin four hundred dollars. I give and bequeath unto my daughter Selena Yoe one hundred dollars. The above legaces are to be paid by my son John in one year after the decease of the said Jane. And lastly it is my wish and desire to have my son take care of my son James if he should come around once and a while as he formally used to do.
And lastly I direct after my decease to have my funeral expenses, tombstones, doctors bills paid out of my estate.
I do hereby nominate and appoint William Tamlin to be the Executor of this my last will and testament hereby revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal this 3 day of Aug 1876.

From everyone you have heard of the death of poor Charles Chavasse. We must
all lament the event, as he certainly was a very promising young man; to his
poor mother his loss was most severe and one I fear that she will long feel. I
heard from Mrs Pye Chavasse today, who much laments the death of her
mother, and speaks of it as the greatest trial she has ever experienced. She has
hitherto been fortunate. My mother-in-law is still living, as is her son Joseph,
who continues so great an invalid as seldom to leave his room. His poor wife I
pity, as she has no t only to nurse a sick Husband, but has the charge also of a
young family, having most years a Babe. His sister, Mrs Biggers, is a widow
with three children. Their good mother lives with her (13).

13. The Steede Family: Dr Richard Steede (d. 1802) lived in Winterbourne,
Glos., but the family seem to originate from Oxfordshire. Charlotte's invalid
brother-in-law, Joseph Steede, lived at Bampton, near Witney, Oxon., where he
died March 17th, 1817, aged 44. In his will, made in 1810, he pays tribute to his
wife, Hester, for her care and devotion during the long and severe illness he had
suffered. Elizabeth Steede, sister to Joseph and Richard, married at Chipping
Norton, October 13th, 1799, Henry Biggers. She was a widow by 1810.
