Text | State of New York Herkimer County To Wit: Be it remembered that on the Eighteenth day of June in the year of our Lord one thousand eight hundred and twenty four before me Natahniel S. Benton Surrogate in and for the County of Herkimer, was presented by one of the devisees therein named, the last will and testament of Henry Hoover late of the town of Herkimer in said County, deceased, for the proof and registry thereof, which said last will and testament is in the words following, that is to say: - The Last Will and Testament of Henry Hoover of the town and County of Herkimer, and State of New York. I, Henry Hoover considering the uncertainty of this mortal life and being of sound mind and memory blessed be Almighty God for the same do make and publish this my last will and testament in manner and form following, that is to say, Item, I give and bequeath unto my son John Hoover the sum of fifty dollars to be paid out of my estate within three years after my decease. Item, I give and bequeath unto my son Adam Hoover two hundred dollars to be paid immediately after my decease out of my estate. Item, I give and bequeath unto my son Peter Hoover the sum of two hundred dollars to be paid out of my estate immediately after my decease. Further more I give and bequeath unto my said son Adam one of my best horses immediately after my decease to be delivered him. Item, I give and bequeath unto my daughter Betsey wife of Robert Sixbury the sum of thirty dollars to be paid out of my estate within three years after my decease. Item, I give and bequeath unto my daughter Nancy wife of Conrad Bishop the sum of thirty dollars to be paid out of my estate within three years after my decease. Item, I give and bequeath unto my two grandchildren Silas Hoover and Betsey Hoover children of my son Jacob Hoover deceased the sum of thirty dollars to be paid out of my estate three years after my decease, share and share alike. Item, I give and bequeath unto my beloved wife Elizabeth one cow and hereby charge all my real estate with her maintenance and support out of which she is always and at all times very? necessary for her convenience and comfort in life to have and not more in lieu of all her thirds and right of dower she may have in and to any estate either real or personal so long as she shall continue my widow and not longer, shall she have her maintenance and support out of my estate. Item, I give and bequeath unto my two sons Richard Hoover and David [next page] Hoover all the residue of all my estate both real and personal and all my right, title and interest in and to any goods and chattels, lands and tenements & hereby bequeath to them their heirs and assigns forever as tenants in common, to share and share alike, whom I also order and direct to pay all the legacies aforemade, and hereby charge the bequest to them made with the payment of the same as well as to fulfil the bequest made to my said wife in every particular. Part of which said land hereby bequeathed to my said sons Richard and David thier heirs and assigns is situate in the town of Fairfield joining on the Highway leading from Paul Nelsons north and part is situate in the town of Herkimer being the lot on which I now live and occupy. Item, If in case I shall advance any money or other thing to any of my children aforenamed for their portion out of my estate as before bequeathed them, there shall be deducted out their bequests after my decease the advances or payments so made. Item, I hereby constitute and appoint my friends Jacob Hoover and George H. Feeter Executors of this my last will and testament hereby revoking and annulling all former wills by me made. Petrie his Jacob X Kellar mark State of New York Herkimer County: To wit: Be it remembered that on the Eighteenth day of June in the year of our Lord one thousand eight hundred and twenty four personally came and appeared before me Nathaniel S. Benton ____? Surrogate in and for the County of Herkimer, aforesaid Richard M. Petrie, who being duly sworn upon his oath declared that he saw said Henry Hoover deceased sign and seal the annexed written instrument purporting to be the last will and testament of the said Henry Hoover deceased bearing date the twenty third day of July in the year of our Lord one thousand Eight hundred and thirteen and heard him the said Henry Hoover publish and declare the same as his last will and testament: That at the time thereof he the said Henry Hoover deceased, was of a sound disposing mind and memory to the best of the knowlwdge and belief of the said Richard Petrie and that the name of the said deponent subscribed to the said will in the presence of the testator and in the presence of John M. Petrie and Jacob Kellar whose names are severally subscribed to the said will as witnesses and that the said John M. Petrie and Jacob Kellar whose names are severally subscribed to the said will as witnesses each subscribed the same thereto in the presence of the Testator. Before me, Nathaniel S. Benton, Surrogate.
